US v. Hammond, 12-30337

Defendants' sentences for maliciously damaging the real property of the United States by fire are vacated and remanded for resentencing, where: 1) the government did not waive its right to appeal the sentences in the plea agreements or otherwise fail to preserve its objections to the sentences; and 2) the district court illegally sentenced defendants to terms of imprisonment less than the statutory minimum.
