United States Ninth Circuit
Gutierrez v. Commissioner of Social Security, 12-15472
The district court properly affirmed the Commissioner of Social Security's denial of claimant's application for supplemental security income under the Social Security Act, where: 1) the administrative law judge (ALJ) did not err in concluding that under 20 C.F.R section 416.920, claimant did not suffer from a disability because he could perform a significant number of jobs in the national economy; 2) the ALJ did not err by defining "region" for purposes of 42 U.S.C. section 1382c(a)(3)(B) as the State of California; and 3) the ALJ did not err in concluding that 2,500 jobs in the State of California constituted a significant number of jobs in the region where claimant lived and that 25,000 jobs also signifies a significant number of jobs in several regions of the country.
