A petition for review of the Board of Immigration Appeals' (BIA) denial of asylum and withholding of removal is granted, where: 1) petitioner met his burden of establishing that the Russian government was unable or unwilling to control nongovernmental actors who persecuted him on account of his sexual orientation; and 2) in order to obtain the relief he requested, petitioner was not required to demonstrate that the Russian government sponsored or condoned the persecution of homosexuals or was unwilling for that reason to control persecution of petitioner.
