United States Ninth Circuit

US v. King, 12-30235

Defendant's convictions for unlawfully dealing in firearms and making false statements to customs officials to gain entry into the United States are affirmed, where: 1) with regard to the unlawful dealing charge, defendant was not entitled to jury instructions requiring the government to prove that the defendant was not acting as an authorized agent of a federal firearms licensee; 2) there was sufficient evidence to prove that the defendant "engaged in the business" of dealing firearms, as required to support the convictions; and 3) the district court did not abuse its discretion in denying the defendant’s motion for a new trial.
