Valle Del Sol Inc. v. Whiting, 12-17152

The district court's preliminary injunction enjoining an Arizona statute, which attempts to criminalize the harboring and transporting of unauthorized aliens within the state of Arizona, is affirmed, where: 1) the individual and organizational plaintiffs had standing; 2) the statute as written was void for vagueness under the Due Process Clause; 3) the provision which attempted to criminalize the harboring and transporting of unauthorized aliens was preempted by federal law and thus invalid under the Supremacy Clause; and 4) the district court did not abuse its discretion in holding that plaintiffs established the elements necessary to grant a preliminary injunction.
