California Association of Rural Health Clinics v. Douglas, 10-17574

In a challenge to California Welfare and Institutions Code section 14131.10, which eliminated certain Medi-Cal benefits that the state deemed optional, including adult dental, podiatry, optometry and chiropractic services, the district court's ruling that section 14131.10 is consistent with the Medicaid Act is reversed and remanded, where: 1) plaintiffs have a private right of action to bring a claim pursuant to 42 U.S.C. section 1983 challenging the validity of section 14131.10; and 2) section 14131.10 conflicts with the Medicaid Act and was therefore invalid because it impermissibly eliminates mandatory services from coverage.
