Schurz v. Ryan, 07-99025

Petitioner's habeas corpus petition challenging his conviction and death sentence for first degree murder is denied, where petitioner's ineffective assistance of counsel claim fails because: 1) petitioner's counsel did present substantial mitigating evidence about his drug abuse and dysfunctional family life; 2) most of the evidence cited by petitioner would be cumulative; and 3) the non-cumulative evidence that petitioner presented was speculative, minimally relevant; and 4) any new evidence was not reasonably likely to have made an impact at sentencing.
