United States Ninth Circuit

US v. Dunn, 12-10388

The district court's denial of defendant's motion for a reduced sentence is affirmed, where: 1) there is jurisdiction to review 18 U.S.C. section 3582(c)(2) discretionary decisions; and 2) the district court did not abuse its discretion in denying the defendant’s motion for reduced sentence because it properly considered the factors under 18 U.S.C. section 3553(a) and relied on facts supported by the record.
