Petition for review of the government's reinstatement of a prior removal order is granted and remanded to Immigration and Customs Enforcement where because the district court hearing the criminal prosecution against petitioner for illegal reentry invalidated on constitutional grounds the prior removal order, the government could not simply rely on a pre-prosecution determination to reinstate the prior order.
