Galindo v. Holder, 08-73477

Petition for review of the Board of Immigration Appeals' (BIA) decision finding petitioner ineligible for cancellation of removal is granted, where the BIA erred in concluding that petitioner's residence "after having been admitted in any status" was not continuous as required by 8 U.S.C. section 1229b(a)(2) because she took a thirteen-day trip to Mexico pursuant to a grant of advance parole. The second petition for review is denied, where the BIA did not abuse its discretion in denying petitioner's motion to reopen because she cannot retract her concessions of removability.
