Murphy v. DirecTV, Inc., 11-57163

The district court's order compelling plaintiffs to arbitrate their putative class action charging defendants with violations of California's Unfair Competition Law and Consumer Legal Remedies Act is: 1) affirmed in part, as to defendant DirecTV because its Customer Agreement was enforceable under AT&T Mobility v. Concepcion, which held that Section 2 of the Federal Arbitration Act preempts the State of California's rule rendering unenforceable, as unconscionable, arbitration provisions in consumer contracts that waive collective or class action proceedings; and 2) reversed in part as to defendant Best Buy, which was not a party to the Customer Agreement, and was not entitled to the benefit of the arbitration clause.
