Petition for review of the Board of Immigration Appeals (BIA) decision denying to petitioner relief, is: 1) denied in part, where substantial evidence supported the BIA's determination that petitioner failed to establish a clear probability of torture; but 2) granted in part and remanded for the BIA to grant withholding of removal, where the evidence compels the conclusion that petitioner will more likely than not be persecuted, based on his status as a homosexual, if he is removed to the Philippines.
