Fox Broadcasting Company, Inc. v. Dish Network LLC, 12-57048

The district court's order denying plaintiff's request for a preliminary injunction against defendant's products that skipped over commercials is affirmed, where: 1) the district court did not abuse its discretion in holding that plaintiff failed to demonstrate a likelihood of success on its copyright infringement and breach of contract claims regarding defendant's implementation of the commercial skipping products; and 2) plaintiff failed to demonstrate a likelihood of irreparable harm from the defendant's creation of television-show copies used to perfect the functioning of one of its commercial-skipping products.
