United States Ninth Circuit

Defendant's sentence for reentry of a removed alien is affirmed without prejudice to his ability to later request, if and when he should return to the United States or waive his right to be physically present at resentencing, that his previous sentence be vacated and he be resentenced, where: 1) defendant has been deported; and 2) the government agrees that defendant was improperly sentenced.
