Chamness v. Maldonado, 11-56303
The district court's order granting defendants summary judgment and denying a motion to intervene in this action challenging the constitutionality of certain sections of California Senate Bill 6, which implemented California Proposition 14, changing aspects of the California election system, is affirmed, where: 1) the appeal challenging the counting of write-in ballots is moot because the California Elections Code has been amended; 2) the law in this case represented a reasonable, nondiscriminatory restriction that imposed a slight burden on speech and was sufficiently supported by the state's important regulatory interests; and 3) the district court did not abuse its discretion in denying the motion to intervene by Julius Galacki, who attempted to run as a write-in candidate in a July 12, 2011 general election for a congressional district.
