United States Ninth Circuit

US v. Huizar-Velazquez, 11-50237

Defendant's sentence for importing wire hangers without paying the proper duties is vacated and remanded, where: 1) the district court erred by applying U.S.S.G. section 2C1.1 (bribery) rather than U.S.S.G. section 2T3.1 (smuggling); and 2) on remand, the district court must determine which duty rates apply to which hangers under the proper sentencing guideline.
