United States Ninth Circuit
Sola v. Holder, 11-71917
Petition for review of the Board of Immigration Appeals' (BIA) decision finding petitioner removable and denying her temporary protective status relief is dismissed for lack of jurisdiction, where: 1) petitioner failed to exhaust the only issue raised in her petition, that the government denied her due process by placing her in removal proceedings without her husband; and 2) because the Immigration Judge or BIA could have addressed petitioner's claim if she had raised it, her claim does not fall within the exception to the exhaustion requirement.
