United States Ninth Circuit

US v. Smith, 11-50549

Defendant's sentence for his conviction of sex trafficking of children by force, fraud, or coercion is affirmed, where: 1) the enhancement for exerting undue influence on a minor was not impermissible double-counting; and 2) the enhancement for an organizing role was proper, where a woman who knowingly abetted defendant's sex trafficking offense qualified as a participant under the Sentencing Guidelines, and thus, defendant was responsible for organizing her for the purpose of carrying out that criminal act.
