Western Watersheds Project v. Abbey, 11-35705

In an action challenging the Bureau of Land Management's (BLM) management of grazing within the Upper Missouri River Breaks National Monument in Montana, the district court's summary judgment in favor of U.S. agencies and officials is affirmed in part and reversed in part where: 1) the BLM reasonably interpreted Proclamation No. 7398 to not require programmatic changes to grazing policies in the management plan and the Environment Impact Statement complied with NEPA by taking a hard and careful look at grazing impacts; and 2) the Environmental Assessment for the Woodhawk Allotment violated NEPA by not considering a reasonable range of alternatives that included a no- or reduced-grazing option.
