Regaldo-Escobar v. Holder, 09-72964

Petition for review of the Board of Immigration Appeals' (BIA) denial of asylum, withholding of removal, and protection under the Convention Against Torture is: 1) granted in part with respect to petitioner's applications for asylum and withholding of removal because the BIA failed to address whether petitioner established a well-founded fear of persecution on account of a political opinion, or sufficient likelihood of future persecution on account of a protected ground; and 2) denied in part, where substantial evidence supported the finding of no past persecution, and the BIA's determination that petitioner failed to establish a clear probability of future torture.
