US v. Ajoku, 11-50230

Defendant's convictions of making false statements relating to health care matters are affirmed, where: 1) there was sufficient evidence to support the convictions; 2) whatever the merits of the defendant's contention that the jury could not return a guilty verdict under a concealment theory without finding the defendant owed a duty to disclose the truth, any error was not plain; 3) the district court did not err in instructing the jury on willfulness or materiality; and 4) the district court did not abuse its discretion in admitting evidence regarding the scope of the alleged billing fraud.
