Gantt v. City of Los Angeles, 11-55000
Judgment in favor of defendants in consolidated action brought under 42 U.S.C. 1983 after plaintiffs' murder convictions were vacated, is reversed and remanded, where: 1) the district court erred in instructing the jury about the level of culpability required for a deliberate fabrication of evidence claim under the Fourteenth Amendment; and 2) the instructional error was not harmless because given the evidence, a reasonable juror could have concluded that defendants used investigative techniques that were so coercive and abusive that they should have known that those techniques would yield false information.
