Dismissal of petitioner's action for a declaratory judgment that he is a United States citizen, although he was born in the Philippine Islands, because his father was a U.S. citizen, is affirmed, where: 1) the Nationality Act of 1940 was not the law in effect at the time of petitioner's birth in 1931; and 2) the Act does not apply retroactively to petitioner.
