Makaeff v. Trump University, LLC, 11-55016
In a dispute brought by plaintiff, a disgruntled former customer, against defendant Trump University for deceptive practices, the district court improperly denied plaintiff's motion to strike defendant's counterclaim for defamation pursuant to California's anti-SLAPP statute, where: 1) defendant Trump University was a limited public figure; and 2) to prevail on the defamation claim, defendant Trump University must demonstrate that plaintiff acted with actual malice.
