In re Motor Fuel Temperature Sales Practices Litigation, 2:07-md-01840-KHVJPO

In three cases referred to the District of Kansas by the Judicial Panel on Multidistrict Litigation for consolidated pre-trial proceedings which have now been remanded back to California for trial, a Certificate of Necessity is denied for the out of circuit judge to travel to California to conduct the trials, where although this would be helpful, the Guidelines for the Intercircuit Assignment of Article III Judges direct that the Certificate can only be signed if the need cannot be filled by judges from other courts within the circuit.
