District court properly denied immigrant petitioner's mandamus petition seeking to compel the defendant to issue him a Stafford Loan, where: 1) The jurisdictional question merges with the merits in these circumstances; and 2) the district court correctly dismissed the petition on the merits because when his Stafford Loan eligibility was reviewed, he did not provide any evidence that he was "in the United States for other than a temporary purpose," as required to receive a Federal Family Education Loan Program loan.
