United States Ninth Circuit
Walker v. Martel, 11-99006
District court's grant of a habeas corpus petition challenging defendant's conviction and capital sentence for murder and related crimes, is: 1) reversed, where on defendant's ineffective assistance of counsel claim, it was not reasonably probable that either defendant's conviction or sentence would have been different had counsel objected to the use of the leg restraint; and 2) remanded for the district court to consider other claims it held in abeyance pending the appeal.
