United States Ninth Circuit

US v. Brizan, 11-10449

Defendant's appeal from a conviction by guilty plea to misprision of a felony is dismissed as waived, where: 1) the waiver of the right to appeal in the plea agreement is enforced because the district court conducted a thorough colloquy including an admonishment regarding the appeal waiver and ensured that the plea was knowing and voluntary; 2) the sentence did not contradict the agreement or exceed statutory limits; and 3) defendant waived her right to raise a Fifth Amendment defense to the misprision charge by pleading guilty.
