United States Ninth Circuit

US v. May, 12-30016

Sentences for convictions of receipt of stolen mail and mail theft are: 1) affirmed in part, where the district court did not err by including in the loss calculation expenses the US Postal Service incurred to avert future mail thefts for purposes of sentencing; but 2) vacated in part, where the district court improperly ordered restitution for the expenses because the mail theft of which the defendants were convicted occurred after, and thus could not have caused, the Postal Service's delivery procedure change.
