Recinto v. US Department of Veterans Affairs, 11-16341
Judgment dismissing claims brought by a group of Filipino World War II veterans and their widows who did not receive payments under the Filipino Veterans Equity Compensation Fund is affirmed, where: 1) under the Veterans Judicial Review Act, a district court does not have jurisdiction over claims that would require it to review a question of fact or law relating to or affecting veterans' benefits and therefore, the court does not have jurisdiction to review plaintiffs' due process claim; and 2) although the court had had jurisdiction to consider plaintiffs' equal-protection challenge because it only involves review of the test of the statute creating the Fund, plaintiffs failed to state a claim for an equal protection violation.
