United States Ninth Circuit
Cunningham v. Wong, 09-99008
In habeas corpus petition challenging a conviction and capital sentence for robbery-murder, denial of petition is affirmed, where: 1) the California Supreme Court did not unreasonably deny petitioner's Brady claims of prosecutorial misconduct; 2) petitioner's claim of prosecutorial misconduct as to statements about petitioner's changed appearance is procedurally barred; 3) there was no error in denying petitioner's multiple claims of ineffective assistance of counsel; 4) the Court did not err in its determination that no Miranda violation occurred; 5) the admission of petitioner's statement, even if erroneously admitted, was harmless; and 6) there is no cumulative error, such that would require reversal.
