US v. Wiggan, 10-50114

Defendant's conviction and sentence for perjury and for making a false statement, stemming from her testimony before the grand jury involving her alleged involvement in a wiretapping conspiracy while working as a facilities technician at SBC Communications, are reversed where: 1) the district court abused its discretion by admitting the grand jury foreman's testimony that the defendant was not credible and the danger of the undue and unfair prejudice far outweighed the probative value of the foreman's testimony; and 2) the error, which was devastating to the defendant's defense, was not harmless.
