Laurel Park Cmty., LLC v. City of Tumwater, 11-35466

In a suit brought by property owners, challenging the constitutionality of city ordinances that seek to preserve the existing stock of manufactured home parks within the municipality by limiting the uses of certain properties, district court's grant of summary judgment in favor of the defendant city is affirmed where: 1) the ordinances, on their face, do not constitute a taking under the Fifth and Fourteenth Amendments; 2) the ordinances do not constitute a taking under the state constitution; and 3) the plaintiffs cannot establish that the ordinances violate their state substantive due process rights.
