In an action for copyright infringement of a training manual for pilot escort vehicle training, district court's grant of summary judgment dismissal of defendant's claim on the ground of laches is affirmed where: 1) plaintiff acted under color of title and in good faith, and therefore did not willfully infringe; and 2) defendant's claim that the district court erred in dismissing the case because it still retained claims for injunctive relief is without merit where the alleged future infringements named as the basis for the injunctive relief are identical to the original infringements, and thus are barred by laches as well.
