Chesbro v. Best Buy Stores, L.P., 11-35784
In plaintiff's class action against Best Buy, alleging that a series of automated telephone calls placed to his home by Best Buy violated the Telephone Consumer Protection Act and the Washington Automatic Dialing and Announcing Device Act, district court's grant of a summary judgment in favor of the defendant is reversed and remanded where: 1) the calls were aimed at encouraging listeners to engage in future commercial transactions with Best Buy to purchase its goods; and 2) the calls constituted unsolicited advertisements, telephone solicitations, and telemarketing, and were prohibited under federal and state laws.
