United States Ninth Circuit

Albino v. Baca, 10-55702

In an inmate's suit against prison officials and others, claiming constitutional violations related to his classification into the general population, district court's grant of defendants' motion for summary judgment is affirmed where: 1) defendant's lack of awareness of the jail's grievance procedure does not make the administrative remedy "unavailable" for purposes of the Prison Litigation Reform Act; and 2) defendant has failed to meet his burden of showing that the jail's grievance procedure was unknowable.
