United States Ninth Circuit

Native Ecosystems Council v. Weldon, 11-35659

In a suit against the United States Forest Service, challenging its small fuels-reduction project in the National Forest in Montana, the judgment of the district court is affirmed where: 1) the Forest Service took the requisite "hard look" at the environmental impact of the project on the elk hiding cover and goshawk populations in the manner required by the NEPA; and 2) the district court did not err in granting summary judgment to the Forest Service on plaintiffs' claims because the Forest Service reasonably considered the relevant factors that could have impacted the elk hiding cover and goshawk populations in its analysis of the project.
