United States Ninth Circuit
Lane v. Facebook, Inc., 10-16380
District court's approval of the parties' $9.5 million settlement agreement, arising from a class action lawsuit against Facebook, Inc. alleging various state and federal privacy rights violations, is affirmed where: 1) the objectors' contention that the settling parties were prohibited from creating a charitable organization to disburse cy pres funds is without merit, and the district court did not abuse its discretion in so concluding; 2) the district court did not abuse its discretion in holding that the settlement was fundamentally fair; and 3) the notice in this case adequately apprised class members of all material elements of the settlement agreement and therefore complied with the requirements of Rule 23(e).
