Schmidt v. Contra Costa County, 11-15563

In a section 1983 suit alleging that a policy adopted by the Superior Court's Executive Committee, which rendered plaintiff ineligible to continue to serve as a temporary commissioner, was in retaliation for her challenge to the incumbent judge in violation of her free speech rights under the First Amendment and the California Constitution, the district court's grant of summary judgment to the defendants is affirmed where although the timing and targeted effect of the policy are suspicious, the judges of the Superior Court's Executive Committee is entitled to legislative immunity for their decision to alter the minimum qualifications to serve as a temporary commissioner.
