Pac. Coast Fed'n of Fishermen's Ass'n v. Blank, 11-17108
In an action challenging the Amendments to the fishery management plan for the trawl sector of the Pacific Coast groundfish fishery, district court's grant of summary judgment in favor of the defendants is affirmed where: 1) the National Marine Fisheries Service (NMFS) complied with the Magnuson-Stevens Fishery Conservation and Management Act (MSA), as a) the NMFS met its statutory obligations to fishing communities, and b) the NMFS was not required to restrict quota shares to those who "substantially participate" in the fishery; and 2) the NMFS complied with National Environmental Policy Act (NEPA).
