In a conviction of a Hollywood movie director for making material false statements to the FBI and to the district court during his guilty-plea hearing, stemming from an illegal wiretapping, the judgment of the district court is affirmed where: 1) the district court did not err in denying defendant's motion to suppress a recording of a conversation between a private investigator and the defendant in which the two discussed an illegal wiretap, as there is no assertion that the private investigator had any criminal intent in making the recording; 2) the district court did not abuse its discretion in declining to hold an evidentiary hearing; and 3) the district court did not abuse its discretion in denying defendant's motions for recusal of a district judge as he has shown no ground to warrant the judge's disqualification from this case.
