United States Ninth Circuit
Monge v. Maya Magazines, Inc., 10-56710
In a suit brought by Latin American celebrities for copyright infringement, arising from the defendants' publication of previously unpublished photos of their wedding in a Spanish-language celebrity gossip magazine, district court's grant of defendants' motion for summary judgment is reversed and remanded, as because the balancing of factors must be weighed against defendants' burden to establish fair use and without a single factor tipping in its favor, defendants' affirmative defense of fair use fails as a matter of law.
