United States Ninth Circuit

US v. Henry, 11-30181

Defendant's conviction for illegal possession of a homemade machine gun is affirmed, as machine guns are "dangerous and unusual weapons" that are unprotected by the Second Amendment and defendant's claim that Congress did not have the authority to enact section 922(o)'s ban on machine guns pursuant to the Commerce Clause is rejected.
