United States Ninth Circuit

Drew v. Equifax Info. Serv., LLC, 11-15008

In plaintiff's suit against Chase Bank and FIA Card Services, arising from a credit dispute caused by identify theft, district court's judgment is reversed in part and affirmed in part where: 1) district court's grant of summary judgment in favor of Chase Bank on the false-reporting claims under the Fair Credit Reporting Act is reversed as issues of material fact remain as to Chase's alleged violations of the Act; 2) district court's dismissal of similar claims against FIA Card Services on statute of limitation grounds is reversed; but 3) the district court did not abuse its discretion in denying plaintiff's motion to amend to reinstate his claims under California law is affirmed.
