United States Ninth Circuit
US v. Valdes-Vega, 10-50249
In a conviction of defendant for drug possession with intent to distribute, district court's denial of a motion to suppress cocaine found in defendant's truck during a stop by border patrol agents 70 miles north of the U.S.-Mexican border is reversed, as the totality of the circumstances did not provide border patrol agents with reasonable suspicion to believe that the defendant was smuggling drugs or aliens.
