United States Ninth Circuit

Haynes v. City and County of San Francisco, 10-16327

District court's imposition of sanctions on the plaintiff's counsel of over $360,000, pursuant to 28 U.S.C. section 1927, after determining that the counsel continued pursuit of his client's claims after it was clear that the claims were frivolous and in bad faith, is remanded because a district court may, in its discretion, reduce a section 1927 sanctions award in light of an attorney's inability to pay.
