Sateriale v. R.J. Reynolds Tobacco Co., 11-55057
In a suit against a tobacco company for breach of contract, promissory estoppels and violation of two California consumer protection laws, arising from defendant's termination of its certificates for merchandise redemption program, district court's dismissal of the action for failure to state a claim is affirmed in part, reversed in part and remanded where: 1) plaintiffs have adequately alleged claims for breach of contract and promissory estoppels; but 2) dismissal of the two state claims are affirmed as there is an absence of an alleged causal connection between the alleged misrepresentations and the plaintiffs injuries under the UCL and the plaintiffs have failed to show actual reliance on the misrepresentation and harm under the CLRA.
