Dennis v. Berg, 11-55674
In a class action suit involving claims of false advertising, district court's approval of the settlement is reversed, vacated and remanded, as the district court abused its discretion in approving the settlement as it did not apply the correct legal standards governing cy pres distributions, and even if the cy pres distributions did comply with the standards, the settlement would still fail because the negotiated attorneys' fees are excessive.
