Gale v. First Franklin Loan Services, 09-16498

In an action alleging violations of the Truth in Lending Act (TILA) and Nevada's covenant of good faith and fair dealing, the District Court's dismissal of the claims is: 1) affirmed in part, where the defendant-lender, in its capacity as loan servicer, was not legally required to respond to plaintiff's letters regarding ownership of his loan; and 2) reversed in part and remanded where after failing to respond to his letter, lender and the other defendants possibly engaged in illegal conduct by wrongfully foreclosing on his property.
