United States Ninth Circuit
Rosa v. TASER International, Inc., 09-17792
In a suit against the manufacturer of electronic control devices, commonly referred to as "tasers," alleging a duty to warn that repeated exposure to its products could lead to fatal levels of metabolic acidosis, brought by the parents of a decedent who died after being repeatedly tased by police during an arrest, the District Court's ruling in favor or TASER is affirmed because the risk of lactic acidosis was not knowable in 2003 and California law would not extend negligence liability to a manufacturer in this circumstance.
